اجازه ولی در نکاح

اجازۀ ولی درنکاح ولی دختر مطابق شریعت اسلامی مکلف است که بایداز زنان تحت تکفل خود قبل از ازدواج در مورد ازدواج اش با شخص خواستگار ، اجازه شرعی بخواهد، و اگر زن راضی به ازدواج نباشد، ولی وی نمی‌تواند او را مجبور به ازدواج کند، پس اگر بدون رضایت او (ولی) او را به عقد کسی درآورد، دختر می‌تواند آن عقد انعقاد شده را فسخ وملغی اعلام بدارد . قابل دقت وتذکر است که ولی بودن درفهم شرعی ، ودخیل بودن آنها در امر زواج ، یک دخالت متحکمانه ودر حقیقت یک ولایت عادلانه و عقلانی است که درآن فهم عالی الهی وسنت رسول الله صلی الله علیه وسلم رعایت ومرعات میشود .
